Pune Porsche Case: Police Challenges JJB’s Refusal to Try Accused as Adult

Police Appeal to Higher Court

The Pune Police have escalated the controversial Pune Porsche crash case by moving an application before the sessions court, challenging the Juvenile Justice Board’s (JJB) decision to reject their plea to try the 17-year-old accused as an adult. Special Public Prosecutor Shishir Hiray confirmed that the prosecution argued the JJB’s ruling was flawed.

According to Hiray, the application was filed on 7 August 2025, and a hearing date will be fixed once the case is listed. An officer from Pune Police added that the necessary approvals from the district collector were secured before approaching the sessions court.

JJB’s Decision Sparks Debate

Last month, the JJB turned down the police request, ruling that the offence did not fall under the “heinous crime” category as per the Juvenile Justice (Care and Protection of Children) Act, 2015. This decision sparked public outrage, especially considering the gravity of the incident.

The Fatal Crash of May 19, 2024

The case stems from an early morning collision on May 19, 2024, when a luxury Porsche car, allegedly driven by the underage accused, crashed into a motorcycle near Kalyani Nagar in Pune. The collision killed two young professionals from Madhya Pradesh — Ashwini Koshta and Aneesh Awadhia — on the spot.

The juvenile driver was apprehended shortly after the crash but was granted bail by the JJB. The bail conditions and perceived leniency triggered widespread criticism, particularly over the accused’s alleged political and social connections.

Allegations of Underage Drinking and Tampering of Evidence

Investigations revealed that the accused was allegedly served alcohol at a Pune restaurant and bar despite being underage. The case took a darker turn when allegations emerged that the juvenile’s parents bribed doctors to swap his blood sample with that of his mother, both at a private facility and the government-run Sassoon Hospital.

These actions were allegedly aimed at shielding the minor from legal consequences by erasing evidence of alcohol consumption at the time of the accident.

Arrests and Bail Developments

The Pune crime branch registered a case against the accused’s parents, two doctors from Sassoon Hospital, and others for conspiracy and evidence tampering. The charges included destruction of evidence and culpable homicide not amounting to murder.

On April 22, 2025, the Supreme Court granted interim bail to the mother of the main accused, who had been arrested for allegedly facilitating the blood sample swap. The father of the accused and the doctors involved remain in judicial custody.

Supplementary Chargesheet and Ongoing Trial

In September 2024, Pune Police submitted a supplementary report before the JJB, adding fresh charges of destruction of evidence against the juvenile. The case against the main accused continues before the Juvenile Justice Board, with the prosecution now pressing to have the accused tried as an adult in the sessions court.

Public Reaction and Legal Implications

The Pune Porsche case has become a flashpoint in the national debate over juvenile justice in India. Critics argue that the existing legal framework often allows underage offenders in severe crimes to escape proportionate punishment. The sessions court’s decision on whether the accused will be tried as an adult is expected to set a significant precedent for similar high-profile cases in the future.
