Delhi Court Sentences Four Convicts to 20 Years in Abduction and Gang Rape Case

 

Court’s Verdict in a Decade-Old Crime

The Karkardooma Court in Delhi has sentenced four convicts, including two women, to 20 years of imprisonment in a brutal case involving abduction, gang rape, illegal confinement, causing hurt, and criminal intimidation. The case, which dates back to 2015, exposed a horrifying scheme where the victim was deceived under the pretext of a job offer but was instead kidnapped with the intent to be sold.

Details of the Crime and FIR Registration

The victim was abducted on August 3, 2015, and taken to Badaun, Uttar Pradesh after being misled by the convicts on the promise of employment. Their true intent was to sell her elsewhere. However, through sheer determination, the victim managed to escape from her confinement in a village in Badaun district. Following this, a First Information Report (FIR) was registered at the Mandawali Police Station in Delhi in 2015.

Sentencing by the Court

Additional Sessions Judge (ASJ) Swati Katiyar delivered the harsh judgment on March 7, 2024, holding all four accused guilty of heinous crimes.

  • Bijnesh alias Deepak and his younger brother Dinesh were sentenced to:

    • 20 years of imprisonment for gang rape
    • 7 years for abduction
    • 1 year for illegal confinement
    • 1 year for causing hurt
    • 2 years for criminal intimidation
  • Their respective wives, Neha alias Sunita and Ruby, were convicted for abetting the crimes and received the same sentence.

Additionally, the court imposed a fine of ₹1 lakh on each convict.



Compensation for the Victim

Recognizing the trauma and suffering of the victim, the court referred the case to the Delhi Legal Services Authority (DLSA) to provide compensation under the Victim Compensation Scheme.

Court Rejects Plea for Leniency

The defense counsel pleaded for leniency, citing the personal circumstances of the convicts. However, the court rejected the appeal, emphasizing the severity of the crime and its impact on society.

In its judgment, ASJ Katiyar stated:
"Considering the gravity of the crime and the cruel, inhuman act of the convicts, a stern sentence is required to act as a deterrent for others. The convicts do not deserve any leniency."

Prosecution’s Case and Evidence

According to the prosecution, the accused lured the victim under false pretenses and then forcibly took her to the village of Madarpur in Badaun district, where she was:

  • Wrongfully confined
  • Beaten and physically assaulted
  • Tormented and threatened

The victim’s courage allowed her to escape, but the court noted that if she hadn’t, she might have been sold off with no chance of returning home.

Importance of Strict Sentencing

The court stressed that mercy in such heinous crimes would be a "travesty of justice". It highlighted the need to protect other women in society from similar dangers and ensure that justice is served.

"The welfare and safety of women in society must be protected. If these convicts are released, they may repeat the offence. The sentencing courts are expected to impose a punishment proportionate to the gravity of the crime," the court stated.

Final Conviction and Justice Served

On March 1, 2024, the court held that the prosecution had successfully proved the charges, confirming that:

  • The accused abducted and confined the victim in a cornfield in Madarpur, Badaun.
  • Bijnesh and Dinesh committed rape, while Neha and Ruby abetted the crime.

With this judgment, justice has been served, and the convicts will now serve their sentences behind bars.
