Supreme Court Issues Statement on In-House Inquiry

On March 15, 2025, the Supreme Court of India issued an official statement confirming that the Chief Justice of Delhi High Court had initiated an in-house inquiry into allegations against Justice Yashwant Varma. A detailed report will be submitted to the Chief Justice of India (CJI) on March 21, 2025.

The apex court also clarified that the in-house inquiry was initiated before the Supreme Court Collegium met on March 20 to discuss judicial appointments and transfers.

Misinformation and Rumors Addressed by Supreme Court

Amid widespread media speculation, the Supreme Court strongly refuted rumors and misinformation regarding alleged incidents at Justice Varma’s residence. The statement emphasized that any action taken will be based on verified facts and due process.


Cash Recovery Controversy Sparks Judicial Action

The inquiry follows allegations of a large amount of cash being recovered from Justice Varma’s official residence in Delhi. According to reports, a fire broke out at his residence on March 14, and firefighters allegedly discovered a stash of cash while dousing the flames. The judge was not present at his residence at the time of the incident.

Subsequently, members of the Delhi High Court Bar Association raised concerns before Chief Justice Devendra Kumar Upadhyaya, urging an investigation. The Delhi HC Chief Justice acknowledged the issue, stating that judges were aware of the developments.

Judicial Transfer Proposal Separate from Inquiry

Amid the controversy, reports emerged about the potential transfer of Justice Varma. The Supreme Court denied that his transfer was recommended by the Collegium due to these allegations, clarifying that:
✔️ The Delhi HC Chief Justice proposed Justice Varma’s transfer before the inquiry began.
✔️ The Supreme Court Collegium sought responses from consultee judges of the Supreme Court, Delhi HC, and Allahabad HC, as well as Justice Varma.
✔️ The Collegium will pass a resolution on the transfer after reviewing all responses.

Additionally, the Supreme Court stated that the proposed transfer of Justice Varma to the Allahabad High Court is independent of the in-house inquiry. If transferred, he would move from being the second senior-most judge in Delhi HC to ninth in seniority at Allahabad HC.

Next Steps: Report Submission & Supreme Court Action

The Supreme Court confirmed that:
🔹 Delhi High Court Chief Justice Devendra Kumar Upadhyaya will submit his report to the CJI on March 21.
🔹 The Supreme Court Collegium will review responses regarding Justice Varma’s transfer.
