On August 3, the Rohini District Court directed the Delhi Police to register an FIR and launch an investigation into allegations of forgery against Bobi Kinnar, the first transgender councillor of Delhi. The complaint, filed by Varuna Devi—who lost the MCD election against Kinnar—claims that Kinnar used a forged caste certificate to secure her nomination for a seat reserved for women from the SC community in the Sultanpuri ward.


Allegations and Complaint


Varuna Devi alleges that Bobi Kinnar obtained a forged caste certificate from Gautam Budh Nagar, UP, in March 2017. According to the complaint, this certificate was later used to obtain a new caste certificate from Delhi, enabling Kinnar to file her nomination for the MCD election. Devi contends that the second certificate was based on false or fabricated documents.


Court's Findings and Orders


During the hearing, Judicial Magistrate Sanya Dalal noted the presence of contradictory reports from the Tehsildar office in Dadri. The court observed that the reports—one from Lekhpal, a revenue officer, and another from the investigating officer—were inconsistent, indicating a need for a detailed investigation.


The court authorized the registration of an FIR under appropriate sections of the law and instructed the SHO Sulatanpuri to investigate the matter thoroughly. The court clarified that this order was not an immediate directive for arrest but a preliminary step to determine whether an offence had been committed.


Evidence and Investigation


The complaint highlights discrepancies in the caste certificate issuance. The Tehsildar Dadri's report dated July 3, 2023, indicated that the certificate issued on March 3, 2017, could not be verified through online records. Furthermore, the address on the certificate was found to be incorrect.


The Action Taken Report (ATR) by the investigation officer dated February 28, 2024, supported the claim that the certificate was issued by the Tehsildar Dadri, but discrepancies in verification remained.


Future Proceedings


The court has scheduled further hearings on August 9 to review the investigation's progress and assess the evidence. The case continues to draw attention due to its implications for electoral integrity and the verification of caste certificates.
