In a significant development, the Delhi Court has sent Delhi Chief Minister Arvind Kejriwal to judicial custody until July 12 in connection with the excise policy case. The decision came after Kejriwal’s three-day Central Bureau of Investigation (CBI) custody ended, and the court decided not to extend it further.


Court's Decision and Immediate Reactions


The Rouse Avenue Court of Delhi ordered the judicial remand of Arvind Kejriwal, following arguments presented by both the prosecution and defense. Advocate DP Singh, representing the CBI, argued that Kejriwal had been uncooperative during his police custody, providing evasive replies contrary to the evidence on record. The court found these arguments sufficient to warrant judicial custody.


AAP’s Response


The Aam Aadmi Party (AAP) has called the court’s decision a conspiracy orchestrated by the Bharatiya Janata Party (BJP). AAP leader Sanjay Singh criticized the CBI's arguments as baseless and reiterated that Kejriwal is being falsely implicated. Delhi Environment Minister Gopal Rai echoed these sentiments, stating that the arrests of AAP ministers and the Chief Minister are part of a larger campaign by the BJP to dismantle the Delhi government.


Nationwide Protests


In response to the court's decision, AAP held nationwide protests, asserting that Kejriwal’s arrest is politically motivated. The party emphasized that the trial court had earlier granted bail to Kejriwal, and the Delhi High Court’s stay on the bail order came without a proper hearing.


BJP’s Stance


Contrarily, the BJP has welcomed the court's decision. Delhi BJP chief Virendra Sachdeva asserted that the law is taking its course and that those who have committed crimes must face the consequences. He criticized the Delhi government's focus on the excise policy during the second wave of COVID-19, suggesting that their priorities were misplaced.


Legal Proceedings and Accusations


Advocate Rishikesh Kumar, representing Kejriwal, opposed the judicial remand, arguing that the CBI had no grounds to seek it. He also requested the court to ensure Kejriwal receives his diabetes medicines, test kits, and home-cooked food during his custody, which the court granted.


The CBI's accusations against Kejriwal include his failure to explain the enhancement of profit margins for wholesalers under the new Excise Policy of Delhi 2021-22 and the hurried approval of the revised policy during the peak of the second COVID-19 wave. The CBI also claimed that Kejriwal was involved in meetings where illegal gratification was demanded from liquor business stakeholders and that ill-gotten money was used in the Goa Assembly Elections.


Future Proceedings


Kejriwal will be produced before the court again on July 12. His legal team plans to move a bail application early next week, hoping for a favorable outcome.
